CITY COUNCIL OF THE CITY OF PLEASANTON <br /> ALAMEDA COUNTY, CALIFORNIA <br /> <br /> RESOLUTION NO. 98-129 <br /> <br /> RESOLUTION AGREEING TO THE EXCHANGE OF <br /> PROPERTY TAX REVENUE FOR ANNEXATION NO. 144 <br /> (HAPPY VALLEY) <br /> <br />WHEREAS, Section 99 of the Revenue and Taxation Code (AB 8) provides, among other <br /> things, that no local agency jurisdictional change can be completed without the <br /> agencies affected by such change first having agreed upon an exchange of property <br /> tax revenue between and among the affected agencies; and <br /> <br />WHEREAS, the Alameda County Mayors' Conference, the City of Pleasanton (Resolution No. <br /> 80-74) and the Alameda County Board of Supervisors (Resolution No. 186574) <br /> have agreed to a method for equitably distributing the property taxes; and <br /> <br />WHEREAS, the City of Pleasanton is applying to the Alameda County LAFCO to annex certain <br /> property know as Happy Valley Annexation No. 144); and <br /> <br />WHEREAS, such specific annexation application needs a resolution from both the City and <br /> County setting forth the exchange of property tax revenues for the annexation to be <br /> completed and filed with the State. <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES <br />AS FOLLOWS: <br /> <br />Section 1: That for Annexation No. 144 (Happy Valley) by the City of Pleasanton, which will <br /> be first effective for the fiscal year following the filing of the Certificate of <br /> Completion with the State Board of Equalization providing the filing occurs prior <br /> to December 31 of the preceding year, the Auditor-Controller of the County of <br /> Alameda shall be directed to cause an exchange. of property tax revenues pursuant <br /> to the provisions of paragraphs No. 1 and 3 of the attached resolution. <br /> <br />Section2: The City certifies that there is no significant commercial and/or industrial <br /> development in the proposed annexation. <br /> <br />Section 3: That the property tax proceeds accruing for the Structural Fire Fund shall be <br /> transferred to the City of Pleasanton. <br /> <br /> <br />
