CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, CALIFORNIA <br /> <br /> RESOLUTION NO. 98-99 <br /> <br /> RESOLUTION APPROVING THE APPLICATION OF DIANE <br /> AND EDWARD CHURKA (COFFEE ROAST EXPRESS) FOR <br /> DESIGN REVIEW APPROVAL, AS FILED UNDER CASE <br /> Z-98-145 (AP-98-04) <br /> <br />WHEREAS, Diane and Edward Churka (Coffee Roast Express) have applied for design review <br /> approval to allow use of the second-floor attic space for an additional 2,453 square <br /> feet of commercial office space in a building under construction located at 780 <br /> Main Street; and <br /> <br />WHEREAS, zoning for the property is C-C (Central Commercial), Downtown Revitalization, <br /> Core Area Overlay District; and <br /> <br />WHEREAS, the use of the second-floor attic space is exempt from the requirements of the <br /> Califomia Environmental Quality Act, because the impacts of development were <br /> analyzed previously through the original Negative Declaration adopted by the City <br /> Council in 1995; and <br /> <br />WHEREAS, the Planning Commission reviewed the proposed project at its meeting of June 24, <br /> 1998 and denied the application; and <br /> <br />WHEREAS, within the time specified by the Pleasanton Municipal Code, the applicant <br /> submitted an appeal to the City Clerk of the City of Pleasanton; and <br /> <br />WHEREAS, a duly noticed public hearing was held before the City Council on July 7, 1998, at <br /> which time all pertinent testimony and documents were reviewed; and <br /> <br />WHEREAS, the City Council determined that the proposed modification to the <br /> previously-approved project, as conditioned, meets all applicable requirements of <br /> the Pleasanton Municipal Code, Downtown Specific Plan, and Downtown Design <br /> Guidelines. <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES <br />AS FOLLOWS: <br /> <br /> <br />
