CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, CALIFORNIA <br /> <br /> RESOLUTION NO. 98-70 <br /> <br /> RESOLUTION REJECTING PROPOSED SETTLEMENT <br /> AGREEMENT CONCERNING THE ALTAMONT LANDFILL <br /> EXPANSION <br /> <br />WHEREAS, the City of Pleasanton has filed litigation challenging the County of Alameda's <br /> certification of an EIR and approval of a use permit for the expansion of the <br /> Altamont land fill operated by Waste Management of Alameda County, Inc.; and <br /> <br />WHEREAS, a proposed settlement agreement was negotiated by staff which, if approved, <br /> would result in the dismissal of the lawsuit by Pleasanton upon approval of a <br /> downsized expansion project by the Alameda County Waste Management <br /> Authority, in addition to other concessions by Alameda Waste Management of <br /> Alameda County, Inc.; and <br /> <br />WHEREAS, at its meeting of May 19, 1998, the City Council received the report of the City <br /> Attorney (SR 98:133 ) regarding the proposed settlement agreement; and <br /> <br />WHEREAS, the City Council received testimony from numerous individuals, including <br /> Alameda County Board Supervisor Scott Haggerty, all of whom urged the City <br /> Council not to approve the Agreement. <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES <br />AS FOLLOWS: <br /> <br />Section 1: The Pleasanton City Council hereby rejects the proposed settlement agreement and <br /> directs staff to continue to pursue the litigation. <br /> <br />Section 2: This resolution shall become effective immediately upon its passage and adoption. <br /> <br /> I HEREBY CERTIFY THAT THE FOREGOING WAS DULY AND <br />REGULARLY ADOPTED BY THE CITY COUNCIL OF THE CITY OF PLEASANTON, AT <br />A MEETING HELD ON MAY 19, 1998 BY THE FOLLOWING VOTE: <br /> <br /> <br />
