Resolution No. 98-38 <br />Page Two <br /> <br />WHEREAS, a Negative Declaration had been prepared and adopted when the First Street <br /> Bridge at Arroyo del Valle Project was approved, following public notice of the <br /> availability of the environmental document, public hearing, and public opportunity <br /> for review and comment. <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES <br />AS FOLLOWS: <br /> <br />Section 1: The City Council finds, determines and orders as follows: <br /> <br /> a. The public interest and necessity require the Project in order to provide <br /> additional traffic capacity to maintain an acceptable level of service and to <br /> improve safety by improving traffic flow, providing a median turning lane, <br /> allowing pedestrian and bicycle access on each side of the bridge, replacing <br /> deteriorated pavement, and providing a new bridge which meets current <br /> seismic standards. <br /> <br /> b. The Project is planned and located in the manner which will be most <br /> compatible with the greatest public good and least private injury because it <br /> only affects seven property owners, while the Project improvements will <br /> currently benefit about 12,000 motorists on each of the east and west ends <br /> of the corridor, as well as pedestrians and cyclists. <br /> <br /> c. The taking of the property interests more particularly described in the <br /> attached Exhibit A is necessary for the Project. <br /> <br /> d. The offer required by Section 7267.2 of the Government Code of the State <br /> of California has been made to the owner or owners of record of such real <br /> property. <br /> <br /> e. On July 16, 1997, the City Council of the City of Pleasanton, by Resolution <br /> No. 97-92, adopted the Negative Declaration for the First Street Bridge at <br /> Arroyo del Valle Project, pursuant to the Califomia Environmental Quality <br /> Act. Notice of Determination for the Negative Declaration was filed with <br /> the Alameda County Clerk on September 2, 1997. <br /> <br /> <br />
