1. FEE. LICENSEE, without previous demand, shall pay LICENSOR for the use <br /> <br />of said premises the fee of $4,400.00 for the pedod of March 1, 1998 to December 31, <br /> <br />2000, payable in advance. <br /> <br /> 2. NATURE OF USE. LICENSEE shall use the real property for the relocation <br /> <br />of a utility pole and overhead utility lines. <br /> <br /> 3. CONDITIONS. This license is conferred on the following conditions, to wit: <br /> <br /> a) It is fully understood and agreed that this License Agreement does not <br /> grant any interest in the subject real. property to LICENSEE, that it is <br /> temporary only, nonassignable and nontransferable. <br /> <br /> b) LICENSEE agrees not to commit or permit the commission of any kind of <br /> nuisance on or to the subject real property, and to comply with all rules, <br /> regulations and management policies now or hereafter established by the <br /> LICENSOR. <br /> <br /> c) ' LICENSOR agrees that the City or its agents, 'are granted the right to <br /> enter upon the remaining land of LICENSOR for the purpose of, but not <br /> limited to, temporarily relocating an existing overhead power line as part <br /> of the City's project to construct improvements in First Street. <br /> <br /> d) It is further agreed that Pacific Gas and Electric, or its agent, will contact <br /> LICENSOR prior to commencing the relocation of the overhead utility <br /> lines to arrange for a mutually agreeable work schedule to accomplish <br /> said relocation work. The time necessary to accomplish the relocation of <br /> the overhead utility lines shall not exceed three days. <br /> <br /> e) A utility pole will be relocated from within the City's right-of-way to a location <br /> within the area described in Exhibit "B". If the City does not form an underground <br /> utility district prior to the expiration of this agreement (December 31, 2000), the <br /> · City, or its agent, shall relocate the utility pole back into the City's right-of-way. <br /> <br /> f) The LICENSEE guarantees that any damage to the property that may result <br /> from the relocation of the utility pole and overhead utility lines will be repaired to <br /> the satisfaction of the LICENSOR at no cost to the LICENSOR.
