6. The grantor agrees that no improvements other than those already on said property, shall be placed <br />thereon; and the planting of any trees, grass or shrubs, or alterations, repairs or additions to existing <br />improvements which may hereafter be placed are at grantor's risk and without expectation of payment <br />in the event of removal by the City of Pleasanton or its authorized agents. <br /> <br />7. It 'is agreed and continned by the parties hereto that notwithstanding other provisions in this <br />contract, the right of possession and use of the subject property by the County or its authorized agents,' <br />including the right to remove and dispose of improvements, shall commence on March 1; 1998, or the <br />close of escrow controlling this transaction, whichever occurs first, and that the payment shown in <br />clause 2(A) herein includes, but is not limited to, full payment for such possession and use, including <br />damages if any from said date <br /> <br />8. The decorative posts located near the existing driveway entrances to the property will be removed <br /> by the City's contractor and given to the owner undamaged. <br /> <br />9. The parking area within the Temporary Construction Easement shall remain unobstructed during <br /> the weekends and after 6:00 P.M. each workday. <br /> <br />10. The City's contractor shall provide for ingress and egress to and from the subject property across at <br /> least one of the two driveway entrances at all times for the duration of the construction activities <br /> associated with the City's project to improve First Street. <br /> <br />11. Any damage caused to the subject driveways or parking lot shall be repaired by the City's <br /> contractor. <br /> <br />12. Driveways will be adjusted and finished to smoothly connect with the new street surface. <br /> <br />13. The surface of that portion of the retaining wall to be constructed between the two driveway <br /> entrances shall be a finished concrete surface. <br /> <br />14. This transaction will be handled through an escrow with Northwestern Title Company, 6000 <br /> Stoneridge Mall Road, Pleasanton, CA, 94588, (510) 224-8800, Escrow No.815813. <br /> <br /> Exhibit "A" Page 8 of 27 <br /> <br /> <br />
