CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, CALIFORNIA <br /> <br /> RESOLUTION NO. 98-28 <br /> <br /> RESOLUTION APPROVING AGREEMENT TERMINATING <br /> JOINT EXERCISE OF POWERS AGREEMENT FOR, AND <br /> PROVIDING FOR THE DISSOLUTION OF, THE <br /> TRI-VALLEY WASTEWATER AUTHORITY <br /> <br />WHEREAS, the Tri-Valley Wastewater Authority (the "Authority") was established and exists <br /> pursuant to a Joint Exercise of Powers Agreement dated March 4, 1986, and <br /> supplemented by Supplemental Agreement 1 dated January 21, 1987 (collectively, <br /> the "Joint Powers Agreement"), entered pursuant to the provisions of Government <br /> Code Section 6500, et seq.; and <br /> <br />WHEREAS, the Authority was established for the purpose of planning, constructing, <br /> maintaining, and operating facilities for wastewater treatment, transmission, <br /> disposal, and/or reclamation and reuse necessary to meet the requirements of the <br /> senrice areas of its member agencies; and <br /> <br />WHEREAS, through cooperative efforts of public agencies, including the member agencies of <br /> the Authority, the aforesaid activities have been, and shall continue to be, <br /> undertaken by other public agencies. <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES <br />AS FOLLOWS: <br /> <br />Section 1: The City Council approves the Agreement enti~ed "Tri-Valley Wastewater <br /> Authority - Agreement Terminating Joint Exercise of Powers Agreement <br /> Establishing Tri-Valley Wastewater Authority and Providing for its Dissolution", a <br /> copy of which is attached hereto and incorporated herein by this reference. <br /> <br />Section 2: This resolution shall become effective immediately upon its passage and adoption. <br /> <br /> <br />
