WHEN RECORDED, RE]URN TO: RECORDED BY: PREANNEXATION AND PROVISION OF WATER AND SEWERAGE FACILITIES AND SERVICE AGREEMENT THIS AGREEMENT is made and entered into this day of ., 1998 by and between the City of Pleasanton, a municipal corporation (hereinafter referred to as "City") and Kevin Maas (hereinaRer referred to as "Owner"), based on the following understandings: WITNES SETH: WHEREAS, Owner wishes to connect to the City water and sewerage systems; and WHEREAS, generally, City policy requires annexation prior to extension of such City services as water and sewerage facilities; and WHEREAS, City, in accordance with State and LAFCO policies and regulations regarding annexation, either cannot or is unwilling to annex small portions of neighboring areas in piecemeal fashion, but may wish to annex such properties either alone or in conjunction with a larger area at some future time; and WHEREAS, the public health, safety, and welfare of the City's residents as well as those in the neighboring community are best served by elimination of inadequate sewerage treatment and well water systems and connection to the City sewerage and water facilities; and WHEREAS, City policy is adequately preserved through the provisions of an agreement wherein Owner consents to annexation to City at such time as City may require; and WHEREAS, City is willing to extend its sewer and water facilities only if there are assurances that the property won't be further subdivided or developed without approval of the City. NOW, THEREFORE, City and Owner hereby agree as follows: 1. Provision of Sewer and Water Service. Owner may connect to City's sewer and water systems upon execution of this Agreement prior to annexation of Owner's land.
