CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, CALIFORNIA <br /> <br /> RESOLUTION NO. 98-21 <br /> <br /> RESOLUTION APPROVING A REVISED AGREEMENT <br /> BETWEEN THE LIVERMORE AMADOR VALLEY <br /> WASTEWATER MANAGEMENT AGENCY (LAVWMA) <br /> AND THE EAST BAY DISCHARGERS AUTHORITY (EBDA) <br /> FOR ADDITIONAL WASTEWATER DISCHARGE <br /> CAPACITY <br /> <br />WHEREAS, on November 4, 1997, the City Council approved an agreement between <br /> LAVWMA and EBDA for additional wastewater discharge capacity; and <br /> <br />WHEREAS, the Castro Valley Sanitary District indicated concern regarding construction <br /> impacts and the need for greater assurances that its capacity would not be <br /> adversely impacted by the agreement; and <br /> <br />WHEREAS, the attached revised agreement with EBDA is substantially the same as the <br /> previous agreement with no changes to the basic terms of the agreement or <br /> financial provisions; and <br /> <br />WHEREAS, minor changes were made primarily to clarify intent; <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES <br />AS FOLLOWS: <br /> <br />Section 1: Approves the Revised Agreement between the Livermore Amador Valley <br /> Wastewater Management Agency (LAVWMA) and the East Bay Dischargers <br /> Authority (EBDA) for additional wastewater discharge capacity. <br /> <br /> Section 2: This resolution shall become effective immediately upon its passage and adoption. <br /> <br /> I HEREBY CERTIFY THAT THE FOREGOING WAS DULY AND <br /> REGULARLY ADOPTED BY THE CITY COUNCIL OF THE CITY OF PLEASANTON, AT <br /> A MEETING HELD ON MARCH 17, 1998 BY THE FOLLOWING VOTE: <br /> <br /> <br />
