CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, CALIFORNIA <br /> <br /> RESOLUTION NO. 98-09 <br /> <br /> RESOLUTION AUTHORIZING SETTLEMENT OF <br /> WORKER'S COMPENSATION CLAIM <br /> <br />WHEREAS, there is now pending before the Workers Compensation Appeals Board cases <br /> concerning James Dignan and Donald Bubeck, City employees, and Donald <br /> Fraasch, a retired fire captain; and <br /> <br />WHEREAS, the City's worker's compensation claims administrator has requested authority <br /> from the City Council to settle these claims in amounts more fully discussed in the <br /> memorandum dated February 5, 1998 from the Director of Personnel to the City <br /> Attorney; and <br /> <br />WHEREAS, such requests are reasonable and justified under the circumstances. <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES <br />AS FOLLOWS: <br /> <br />Section 1: The City Attorney is authorized to settle the above-mentioned cases in the amounts <br /> not to exceed that requested by the Director of Personnel. <br /> <br />Section 2: This resolution shall become effective immediately upon its passage and adoption· <br /> <br /> I HEREBY CERTIFY THAT THE FOREGOING WAS DULY AND <br />REGULARLY ADOPTED BY THE CITY COUNCIL OF THE CITY OF PLEASANTON, AT <br />A MEETING HELD ON MARCH 3, 1998 BY THE FOLLOWING VOTE: <br /> <br />AYES: Councilmembers - Ayala, Dennis, Michelotti, Pico, and Mayor Tarvet <br />NOES: None <br />ABSENT: None <br />ABSTAIN: None <br /> ATTEST: <br /> <br />Michael H.
