CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, CALIFORNIA <br /> <br /> RESOLUTION NO. 98-05 <br /> <br /> RESOLUTION RESCINDING ORDINANCE 1731 WHICH <br /> APPROVED THE APPLICATION OF PONDEROSA HOMES <br /> FOR PREZONING AND DEVELOPMENT PLAN APPROVAL <br /> AS FILED UNDER CASE PUD-96-10 <br /> <br />WHEREAS, on December 16, 1997, the City Council adopted Ordinance No. 1731, <br /> conditionally approving the application of Ponderosa Homes for prezoning to PUD' <br /> (Planned Unit Development) - MDR (Medium Density Residential) District and <br /> development plan approval for a 300-unit, single-family development located on <br /> an approximately 92 acre parcel located at 3380 and 3450 Mohr Avenue; and <br /> <br />WHEREAS, a referendum petition was filed within the statutory time limit and forwarded to the <br /> Alameda County Registrar of Voters for signature verification; and <br /> <br />WHEREAS, the Registrar of Voters has certified that the petition contains more than the <br /> required 3,449 verified signatures necessary for a successful referendum petition; <br /> and <br /> <br />WHEREAS, pursuant to Elections Code Section 9241, the City Council shall either rescind the <br /> ordinance or call for an election to place the repeal of the ordinance before the <br /> voters; <br /> <br />WHEREAS, at its meeting of February 3, 1998, the City Council received the report of the City <br /> Attorney (SR 98:32) describing the options available. <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES <br />AS FOLLOWS: <br /> <br />Section 1: The City Council hereby rescinds Ordinance No. 173 1. <br /> <br />Section 2: This resolution shall become effective immediately upon its passage and adoption. <br /> <br /> <br />
