IN CONNECTION <br />WITH THE DEVELOPMENT KNOWN AS STONERIDGE CORPORATE PLAZA II <br /> <br />THIS FIRST AMENDMENT TO DEVELOPMENT AGREEMENT ("First <br />Amendment") is made and entered into this 6th day of Januarv <br />1998 by and between the CITY OF PLEASANTON, a municipal <br />corporation organized and existing under the laws of the State of <br />California (the "City"), and CROCKER PROPERTIES, INC., a wholly <br />owned subsidiary of Wells Fargo Bank, N.A., a national banking <br />association (the "Developer"). <br /> <br />RECITALS <br /> <br />A. WHEREAS, on July 10, 1990, the City Council approved <br />the Development Agreement between City and Developer pursuant to <br />California Government Code Section 65864 et sea., by its <br />Ordinance No. 1472, and said Ordinance became effective on <br />August 9, 1990; and <br /> <br />B. WHEREAS, the Development Agreement was recorded in the <br />Office of the Recorder of Alameda County on August 20, 1990, as <br />Instrument No. 90-224582; and <br /> <br />C. WHEREAS, City and Developer desire to amend the <br />Development Agreement to extend its term by an additional five <br />(5) years; and <br /> <br />D. WHEREAS, development of Developer's project ("Project") <br />in accordance with this First Amendment will provide orderly <br />growth and development of the subject property in accordance with <br />the policies set forth in the General Plan; and <br /> <br />8PHSF6,CJB\0212254.02 <br />01/05/98 <br /> <br />1. <br />
