CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, CALIFORNIA <br /> <br /> RESOLUTION NO. 97-135 <br /> <br /> RESOLUTION APPROVING FORMATION OF THE <br /> LAUREL CREEK ESTATES GEOLOGIC HAZARD <br /> ABATEMENT DISTRICT AND APPOINTING THE <br /> PLEASANTON CITY COUNCIL AS THE BOARD OF <br /> DIRECTORS <br /> <br />WHEREAS, pursuant to the provisions of Section 26550 of the California Public Resources <br /> Code, the City Council adopted Resolution No 94-118A declaring that the City <br /> Council is subject to the provisions of Division 17 (Sections 26500 et seq.) of the <br /> Code, and forwarded a copy of Resolution No. 94-118A to the State Controller; <br /> and <br /> <br />WHEREAS, pursuant to Division 17 of the Public Resources Code, a Petition dated October 13, <br /> 1997, was filed with the City Clerk for the formation of the Laurel Creek Estates <br /> Geologic Hazard Abatement District CGHAD"); and <br /> <br />WHEREAS, on October 18, 1997, the City Council adopted Resolution No. 97-128 initiating <br /> the proceedings for the formation of the CHAD and setting a hearing on the filed <br /> Petition for Formation on November 18, 1997, at 7:00 p.m.; and <br /> <br />WHEREAS, notice of the hearing was given in accordance with the provisions of Public <br /> Resources Code Sections 26557-58 and 26561-63; and <br /> <br />WHEREAS, a public heating before the City Council on the formation of the Laurel Creek <br /> Estates CHAD was held on November 18, 1997 at 7:00 p.m.; and <br /> <br />WHEREAS, at the time set for the hearing, no owner of real property within the proposed <br /> CHAD had made a written objection to its formation in accordance with the <br /> provisions of Public Resources Code Section 26564; and <br /> <br />WHEREAS, at the hearing the owners of more than 50 percent of the assessed valuation of the <br /> proposed GHAD did not object to the GHAD's formation; and <br /> <br /> <br />
