<br />CITY COUNCIL OF THE CITY OF PLEASANTON <br />ALAMEDA COUNTY, CALIFORNIA <br />RESOLUTION NO. 97-128 <br />RESOLUTION INITIATING PROCEEDINGS FOR THE <br />FORMATION OF THE LAUREL CREEK ESTATES <br />GEOLOGIC HAZARD ABATEMENT DISTRICT (GRAD) <br />WHEREAS, on October 18, 1994, pursuant to Section 26550 of the Public Resources Code, <br />this Council adopted Resolution No. 94-118A, declaring that the Council is subject <br />to the provisions of Division 17 (§26500 et sea.) of said Code, and forwarded a <br />copy of said Resolution to the State Controller; and <br />WHEREAS, pursuant to the provisions of said Division 17 of said Code, a petition was filed <br />with the City Clerk, dated October 13, 1997, for the formation of a geologic <br />hazard abatement district ("GRAD") for the Laurel Creek Estates project area; and <br />WHEREAS, said petition complies with the provisions of Public Resources Code §26552 and <br />has attached to it a legal description of the boundaries of the territory to be <br />included within the proposed GRAD (Exhibit "A"), a map showing the boundaries <br />of the territory to be included within the proposed GRAD (Exhibit "B") and a plan <br />of control (Exhibit "C"); and <br />WHEREAS, the City Clerk has reviewed said petition and determined that it is substantially in <br />the form described in Public Resources Code §§26551, 26552 and 26553, and <br />verified that the signatures affixed to the petition represent the owners of all of the <br />real property to be included within the proposed GRAD, and further verified that <br />the signatwes thereon were secured within 120 days of the date on which the first <br />signature on the petition was affixed and that said petition was submitted to the <br />City Clerk within 30 days after the last signature was affixed; <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES <br />AS FOLLOWS: <br />Section 1: This resolution is made pursuant to Division 17 (§26500 et se4.} of the Public <br />Resources Code. <br />Section 2: The City Council has been presented with and has reviewed the plan of control <br />submitted with the petition for the proposed GRAD and has determined that the <br />public health, safety and welfare require formation of the GRAD. <br />
