CITY COUNCIL OF THE CI T Y OF PLEASANTON <br />ALAMEDA COUNTY, CALIFORNIA <br />RESOLUTION NO. 97-126 <br />RESOLUTION ABANDONING THE OPEN OFFER OF <br />DEDICATION OF AN EXTENSION OF MARES COURT <br />THROUGH LOTS 11 AND 12 OF TRACT 6563, OAK TREE <br />FARM <br />WHEREAS, in 1991, the City approved a planned unit development (PUD) for Oak Tree Farm, <br />a 91-acre site located on the west side of Foothill Road across from the old Verona <br />bridge; and <br />WHEREAS, with the Final Map (Tract 6563) for the project, the developers of Oak Tree Farm <br />made an open offer of dedication to the City to extend Mazes Court across Lots 11 <br />and 12 of Tract 6563 to two potential hillside lots in an open space area in Parcel <br />C of Tract 6563; and <br />WHEREAS, the City Council rejected this offer on the final map subject to the right of the City <br />to accept it in the future, pursuant to Section 66477.2 of the California <br />Government Code; and <br />WHEREAS, thereafter, the project developer applied for and was granted a minor modification <br />to eliminate the two hillside lots (within Parcel C) from the approved PUD and to <br />permit the developer to deed approximately 50,000 square feet of the open space <br />in Parcel C to the owners of Lots 11 and 12, which lots are immediately east of <br />said open space; and <br />WHEREAS, as a result of this minor modification and deed, the extension of Mazes Court <br />through Lots 11 and 12 designed to reach Parcel C is no longer needed; and <br />WHEREAS, abandonment of an offer of dedication of a street is governed by Section 66477.2 <br />of the California Government Code; and <br />WHEREAS, the CEQA Guidelines provide that abandonment of an offer of dedication of a <br />street is categorically exempt from CEQA provisions; <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES <br />AS FOLLOWS: <br />
