r <br />• <br />CITY COUNCIL OF THE CITY OF PLEASANTON <br />ALAMEDA COUNTY, CALIFORNIA <br />RESOLUTION NO. 97-124 <br />RESOLUTION DENYING THE APPEAL OF STEVE <br />CAMPISI OF A DECISION OF THE PUBLIC WORKS <br />DIRECTOR, THEREBY DENYING THE REQUEST TO <br />REMOVE A HERITAGE TREE AT 4909 FOREST HILL <br />DRIVE <br />WHEREAS, Steve Campisi is the owner of property at 4909 Forest Hill Drive and on that <br />property is a Mexican Fan Palm tree that is a heritage tree under the City's <br />Heritage Tree Ordinance (Chapter 17.16, Pleasanton Municipal Code); and <br />WHEREAS, on April 3, 1997, Mr. Campisi requested removal of the tree because he felt the <br />tree poses a hazard in that it is raising the concrete pathway, has regular frond drop <br />which poses a safety problem and presents a water drainage problem to the house; <br />and <br />WHEREAS, the Director of Public Works determined that the necessary findings under the <br />Ordinance could not be made and therefore denied the request of Mr. Campisi to <br />remove the heritage tree; and <br />WHEREAS, Mr. Campisi appealed that decision to the City Council; and <br />WHEREAS, at its meeting of October 7, 1997, the City Council considered the report of the <br />Public Works Director (SR 97:294) and conducted a hearing on the appeal; and <br />WHEREAS, the City Council finds and determines that the tree is not diseased, does not meet <br />any of the other criteria for removal under the Ordinance, and that the tree has not <br />recently been pruned in order to remove the dead fronds from the tree. <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES <br />AS FOLLOWS: <br />Section 1: The appeal of Steve Campisi is denied, thereby denying his request to remove the <br />heritage tree from the property at 4909 Forest Hill Drive. <br />Section 2: This resolution shall become effective immediately upon its passage and adoption. <br />
