Resolution No. 97-108 <br />Page Two <br /> <br />WHEREAS, each participant in the Electric Program will be represented on the Board of <br /> Directors of ABAG POWER by a director, or in his/her absence by an alternate, <br /> appointed by the participant; and <br /> <br />WHEREAS, the City of Pleasanton finds that it is in its best interest and the public interest to <br /> join ABAG POWER and participate in ABAG's Electric Program. <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES <br />AS FOLLOWS: <br /> <br />Section 1: Authorizes the City Manager to execute and deliver the "Joint Powers Agreement <br /> creating the ABAG Publicly Owned Energy Resources". <br /> <br />Section 2: Authorizes the City Manager to execute and deliver the Direct Access Electric <br /> Aggregation Agreement in substantially the form, or in conformance with the <br /> principles, set forth in Exhibit B. <br /> <br />Section3: Designates the Director of Public Works, or his designee, as the City's <br /> representative to the Board of Directors of ABAG POWER. <br /> <br />Section 4: This resolution shall become effective immediately upon its passage and adoption. <br /> <br /> I HEREBY CERTIFY THAT THE FOREGOING WAS DULY AND <br />REGULARLY ADOPTED BY THE CITY COUNCIL OF THE CITY OF PLEASANTON, AT <br />A MEETING HELD ON SEPTEMBER 16, 1997 BY THE FOLLOWING VOTE: <br /> <br />AYES: Councilmembers - Ayala, Michelotti, Pico, and Mayor Tarver <br />NOES: None <br />ABSENT: Councilmember Dennis <br />ABSTAIN: None <br /> <br /> Pem/A l&o, Clerk <br />AP~A~O ~ <br />Michael H.
