becomes operational or (ii) until the issue of City's participation in LAVWMA's <br /> Expansion Project is finally resolved as provided in Paragraph 19 of LAVWMA's <br /> JPA, whichever event is later. <br /> Provided that the expansion component of LAVWMA's Expansion Project <br /> is operational, the following provisions shall govern the effect of City's decision <br />- (which must be made within the aforementioned option period) to participate, or not <br /> to participate, in District's Clean Water Revival Project: <br /> (I) If City chooses not to participate in District's Clean Water Revival <br /> Project, and irrespective of whether City participates in the expansion <br /> component of LAVWMA's Expansion Project; <br /> (a) all Disposal Capacity Rights and, if any, all Recycled Water <br /> Rights (except for those Recycled Water Rights from all or any part <br /> of the effluent emanating from City's sewerage service area ("City's <br /> effluent") as provided in (d) below) and Recycling Credits (and <br /> corresponding Disposal Capacity Rights) accruing from District's <br /> Clean Water Revival Project shall remain allocated to District; <br /> provided, unless and until City decides not to participate in District <br /> Clean Water Revival Project, the economic benefits from the <br /> Recycled Water Rights, if any, shall accrue to the Regional Fund; <br /> (b) District shall not allocate or expend any of the net revenues <br /> from the uniform regional connection or service fee imposed pursuant <br /> to Paragraph 10(a) or (b) of the Basic Agreement attributable to City's <br /> sewerage service area for District's Clean Water Revival Project, <br /> except as provided in Paragraph 4© (Temporary Use of Funds); <br /> © City may nevertheless convey, lease, assign, license, permit <br /> or otherwise transfer all or any part of City's effluent or use City's <br /> effluent for an operating project by City; <br /> (d) to the extent City's effluent has not been committed or used <br /> as provided in © above. and except as provided in (e) below, District <br /> may, for the operation of District's Clean Water Revival Project, use <br /> City's effluent, but before District uses City's effluent for the operation <br /> of said Project, City must agree (which agreement will not be <br /> <br /> Agmt-10b 7 <br /> 8r27/97 <br /> <br /> <br />
