determines that the question of City's participation in the project shall be submitted <br /> to the electorate (which determination must be made within the aforesaid sixty (60) <br /> day period), then the time for objection shall be extended to sixty (60) days <br /> following the election (which shall be held no later than the next established <br /> election date following City's determination to seek voter approval). <br />- If a party timely objects. all expenditures or obligations for expenditures <br /> made from and after project approval under CEQA, or the determination that the <br /> project is not subject to CEQA, as the case may be, shall be included in the <br /> calculation of expenditures subject to the requirement that they shall have no <br /> adverse financial impact upon the objecting party. Nothing herein contained shall <br /> be deemed a limitation upon expenditure of revenues from the uniform regional <br /> connection fee for planning projects, including, without limitation, planning <br /> expenditures which may be necessary to propose projects for inclusion on the list <br /> of projects to be established and reviewed by the above-mentioned committee. <br /> © I,,AVWMA'.~ Ex_oansion Pro_iect: District's Clean Water Revival Pro_iect. <br /> Notwithstanding the provisions of Paragraphs 6(b), above, if City does not <br /> participate in the expansion component of LAVWMA's Expansion Project, District <br /> shall not allocate or expend any amount of the net revenues from the uniform <br /> regional connection or service fees imposed pursuant to Paragraphs 10(a) and (b), <br /> respectively, of the Basic Agreement, attributable to City's sewerage service area <br /> for said component. District may allocate anc~ expend such connection fee revenues <br /> attributable to City's sewerage service area for District's Clean Water Revival <br /> Project: provided= that there is no adverse financial impact to City by doing so. For <br /> purposes of District's Clean Water Revival Project, only expenditures or obligations <br /> for expenditures made from and after January 21, 1997 shall be included in the <br /> calculation of revenues attributable to City's sewerage service area. <br /> (d) Fund Management. District shall continue to manage, administer and <br /> account for the revenues attributable to the uniform regional service charge and the <br /> uniform regional connection fee as provided in the Basic Agreement. The parties <br /> agree that, in order to carry out the provisions of Paragraphs 4, 5, 6(b) and 6(c), <br /> above, they cooperate in accounting for the revenues attributable to their respective <br /> sewerage service areas from imposition of the aforesaid uniform regional <br /> <br /> Agmt-10b 13 <br /> 8/27/97 <br /> <br /> <br />
