The parties further acknowledge [bat, in February 1997, they entered into a <br /> "Tolling Agreement," which has subsequently been amended, for the purpose of <br /> tolling the statute of limitations under Public Resources Code Section 21167 <br /> regarding any challenge by City to [he environmental review conducted by District <br /> for District's Clean Water Revival Project. City shall allow the challenge period <br />- regarding such environmental review to expire without filing such a challenge upon <br /> the earlier of (I) acceptance by City of the well sites selected by District for District's <br /> Clean Water Revival Project or (ii) approval of the engineer's report by DOHS for <br /> District's Clean Water Revival Project. District shall enter into an extension or <br /> extensions of said Tolling Agreement to provide for the earlier of said two events. <br /> ( f ) Irrigation Water. Subject to, and in accordance with, provisions governing <br /> the allocation of Recycled Water Rights to City pursuant to Paragraph 4(b) above, <br /> District shall make demineralized water from District's Clean Water Revival Project <br /> available to City for irrigation purposes and shall make reasonable accommodations <br /> during design of the Project to facilitate such use. <br /> 5. LAVWMA's Expansion Pro_iect. The parties acknowledge that City's <br /> decision to participate in the expansion component of LAVWMA's Expansion <br /> Project shall be made as provided in Paragraph 19 of the LAVWMA JPA. With <br /> respect to said expansion component, and consistent with the provisions of <br /> paragraph 23 (Accounting for Funds and Expenditures) of the LAVWMA JPA, <br /> District shall not allocate or expend any net revenues from the uniform regional <br /> connection or service fees imposed pursuant to Paragraphs 10(a) and 10(b), <br /> respectively, of the Basic Agreement attributable to City's sewerage service area <br /> in furtherance of said component unless and until City shall have decided to <br /> participate therein. <br /> 6. Planning Process; Expenditure Policies Governing .Project,~, <br /> (a) Planning Process. The parties acknowledge that Paragraph 16 of the <br /> Basic Agreement requires that their respective representatives meet at least <br /> annually to review the implementation and administration of said Agreement.
