Commissioner Arkin moved to make the fiu dings to modify the use permit for <br />UP-88-17 as recommended in pages 1-3 of the staff report, with the following <br />modificationsc <br />1_ Condition No_ 20 Food shall be served at all times that alcohol is served, <br />2_ Condition No_ 10: The business shall comply with State law as well as <br />Pleasanton Municipal Code about smoking in public and work places <br />3_ Add a new condition that the use permit come before the Planning <br />Commission six months after operation starts, at which time the operator <br />and/or owner will bring forward design ideas if they had not already done so <br />through the staff administrative design review. <br />Commissioner Blank seconded the motion~ <br />ROLL CALL VOTE- <br />AYES: Commissioners Arkin, Blank, Fox, Maas and Roberts_ <br />NOES: None_ <br />ABSTAIN: None. <br />RECUSED: None. <br />ABSENT: None_ <br />Resolution No_ PC-2005-09 was entered and adopted as motioned. <br />The Planning Commission recessed for a break at 8:36 p.m. <br />Chairperson Maas reconvened the meeting at 8.44 p_m_ <br />b_ PDR-441_ Gene Finch <br />Application for design review approval to create an approximately <br />1,495-square-foot dwelling unit on the second floor of the existing building <br />located at 3 ] 2 St Mary Street. Zoning for the property is C-C (Central <br />Commercial, Downtown Revitalization, and Core Area Overlay District. <br />Mr_ Pavan summarized the staff report and described the application. Staff believed the <br />overall design is attractive and would complement the building designs on Main Street <br />and St_ Mary Street- This use would reduce the parking requirement for the facility; the <br />building has access to the municipal parking lot towards the rear. This application has <br />been reviewed by the PDA, which gave the application its full support.
