In response to an inquiry by Commissioner Roberts regarding the tanks for the new fire <br />station, Ms. Stefani replied that they were installing above-ground tanks which were also <br />LEED-certified. <br />In response to an inquiry by Commissioner Arkin regarding the capacity of the tanks, <br />Ms. Stefaai believed they were approximately 1,000 gallons. <br />In response to an inquiry by Commissioner Arkin regarding the original noticing of this <br />application, Mr. Pavan replied that applications of this nature that require only staff-level <br />approval do not typically go through a notiticatio» process; therefore, no noticing was <br />done for the original application. However, for the appeal, notices were sent out to all <br />property owners and residents within a 1000-foot radius of the project site_ <br />THE PUBLIC HEARING WAS CLOSED_ <br />Commissioner Fox noted that she would recuse herself from the vote because she was not <br />present for the entire hearing. <br />Commissioner Roberts believed this use was as safe as an underground tank and added <br />that the possibility of leakage into Sycamore Creek would be lessened with an <br />above-ground tank. <br />Commissioner Roberts moved to deny PAP-74, and to uphold the Zoning <br />Administrator's approval of Case PDR-427, subject to the conditions of approval as <br />shown on Exhibit B of the staff report_ <br />Chairperson Maas secouded the motion_ <br />Commissioner Blank noted that he could not support this motion, primarily because <br />insufficient notice had been given to the neighbors. He noted that there were issues with <br />the County Recorder and the list of homeowners. He believed the public had a right to <br />fully express their opinions. He would like to see more data on the differences in safety <br />records over the past five years. He would like the National Transportation Safety <br />Board (NTSB~ records checked on these uses because of its relation to interstate transit. <br />He also would like more assurance on the emergency spill plans and contair~nient and <br />believed that an alternate location should. be considered. <br />Commissioner Arkin agreed with Coii~tiiissioner Blank's statements and added that he <br />could not support this motion. He would like further information about the safety aspects <br />of this use_ <br />In response to an inquiry by Commissioner Roberts about the safety of the above-ground <br />tanks for the fire station, Commissioner Arkin did not believe that aspect was fully <br />explored_ <br />PLANNING COMMISSION MINUTES January ] 2, 2005 Page 9 of 21 <br />
