CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, CALIFORNIA <br /> <br /> RESOLUTION NO. 97-55 <br /> <br /> RESOLUTION DENYING THE APPEAL AND <br /> UPHOLDING THE ZONING ADMINISTRATOR' S <br /> APPROVAL OF A PUD MODIFICATION TO <br /> ELIMINATE THE PRIVATE PEDESTRIAN TRAIL <br /> FOR GOLDEN EAGLE FARM, PHASE 2, AS FILED <br /> UNDER CASE AP-97-03/PUD-85-15-1}M <br /> <br />WHEREAS, Curfin Construction applied for a modification to eliminate the private <br /> pedestrian trail system amenity from the open space area of the Golden <br /> Eagle Farm - Phase 2 (west side of Foothill Road) subdivision; and <br /> <br />WHEREAS, zoning for the property is PUD (Planned Unit Development) - LDR (Low <br /> Density Residential) District; and <br /> <br />WHEREAS, the Planning Commission recommended approval of the modification; and <br /> <br />WHEREAS, the City Council of Pleasanton appealed the decision; and <br /> <br />WHEREAS, at its duly noticed public hearing of June 3, 1997, the City Council, <br /> considered all public testimony, relevant exhibits, and recommendations of <br /> the City staff and the Planning Commission concerning this application; <br /> and <br /> <br />WHEREAS, the City Council determined that the replacement of this private on-site trail <br /> within twelve (12) months with a comparable amenity chosen by the <br /> Golden Eagle Farm Homeowners Association would satisfy the intent of <br /> providing private amenities in the subdivision and is in the best interests of <br /> the residents of this development; and <br /> <br />WHEREAS, projects of this nature are categorically exempt from the requirements of the <br /> California Environmental Quality Act (CEQA); therefore, no environmental <br /> document was prepared for this project; <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON <br />RESOLVES AS FOLLOWS: <br /> <br /> <br />
