PLANNING COMMIS SION CITY OF' PLEASANTON <br />ALAMEDA COL7NTY, CALIFORNIA <br />RESOLUTION NO. PC-2005-50 <br />RESOLUTION DENYING THE APPLICATION OF HEINRICH FISCHER FOK. A MAJOR <br />MODIFICATION, AS FILED UNDER CASE PUD-85-O1-4M <br />WHEREAS, Heinrich Fischer has applied for a major modit3cation to ati approved Planned <br />Unit Development (Charter Oaks to allow a retractable canvas awning at the rear <br />f~gada of an existing residence located at 1576 Poppybank Court- and <br />WHEREAS, zoning for the property is PUD-MDR (Planned Unit Development -Medium <br />Dcn sity Residential District; and <br />WHEREAS, at its duly noticed public hearing of October 26, 2005, the Planning Commission <br />considered all public testimony, relevant exhibits, and rccomtaendations of the <br />City staff concerning this application; and <br />WHEREAS, projects of this nature are categorically exempt front the requirements of the <br />California Environmental Quality Aci (CEQA). <br />WHEREAS, the Planning Commission determined that the proposed project is not consi stant <br />with the appearance of the existing buildings in the area and not appropriate Ibr <br />the site. <br />NOW, TI-3EREFORE, THE PLANNING COMMISSION OF THE CITY OF PLEASANTON <br />RESOLVES THE FOLLOWING: <br />Section 1 . Denies Case PDUP-8, the application of Heinrich Fischer has applied for a major <br />niodil3cation to an approved Planned Unit Development ~Chartcr Oaks to allow a. <br />retractable canvas awning at the rear fagade of an existing residence located at <br />7 576 Poppybarilc Court_ <br />Section 2. 'I'bis resolution shall become effective 7 5 days after its passage and adoption <br />unless appealed prior to that time- <br />
