PLANNING COMMISSION CITY OF PLEASAN'I'ON <br />A LAMEDA COUNTY, CALIFOKNIA <br />RESOLUTION NO- PC-2005-39 <br />RESOLUTION RECOMMENDING APPROVAL OF THE APPLICJATION OF FI2_ANK AND <br />BARBARA BER LO GAR AND KENNETH AND PAMELA CH RISMAN FOR A MAJOR <br />MODIFICATION TO A PLANNF_D iTN iT DEVELOPMENT DEV ELOYMENT PLAN, <br />AS FILED CINDER CASE PUD-OS-IM <br />WHEREAS, Frank and Barbara Berlogar and Kenneth and Pamela Chrisman have applied for a <br />rnaj or moth Fication to an approved Planned Unit Development development plan <br />to replace the approved house design plans on the Berlogar portion with design <br />guidelines and to separate development of the overall prof cct into two phases on a <br />1 3.2-acre site located at 1944 and 2200 Vineyard Avenue in the Vineyard Avenue <br />Corridor Specific Plan Area- artd <br />WHEREAS, zoning for the property is PUD-CDR (Planned Unit Developtn ent -Low Density <br />Residentia]~ District; and <br />WHEREAS, at its duly noticed public hearing of August 1 O, 2005, the Planning Commission <br />considered all public testimony, relevant exhibits, and recommendations of the <br />City staff concerning this application; and <br />WHF_REA S, environmental review i~~r the proposed project was undertaken with the Final <br />Environmental Impact Report ~EIR~ approved by the City Council for the <br />Vineyard Avenue Corridor Specific Plan in conformance with the standards of the <br />California Euviron mental Quality Act (CEQA); and there are no substantial <br />changes to the project or to the circumstances under which the project is being <br />undertaken that involve new significant environmental effects or that substantially <br />increase the severity of previously idatttified effects, Furthermore, there is no new <br />information of substantial importance, which was unknown at the time that the <br />Final EIR was approved by the City Council regarding the project or its effects, <br />mitigation measures, or alternatives: and any previously identified aP£ects or <br />in-tpacts are mitigated to a level of insignificance, with the mitigation meas ures <br />incorporated into the project's design or imposed on the project pursuant to the <br />conditions of approval:, and <br />WHEREAS, the Platming Commission determined that the proposed modiFcation would be <br />consistent with other recently approved projects in the area and would not alter <br />the natural topographical features of the area- <br />
