CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, CALIFORNIA <br /> <br /> RESOLUTION NO. 97-50 <br /> <br /> RESOLUTION ACCEPTING THE BASIC TIER RATE <br /> AND AUTHORIZING THE CITY MANAGER TO <br /> ISSUE A COMPLAINT TO THE FCC REGARDING <br /> THE NEW EXPANDED TIER RATE <br /> <br />WHEREAS, the Cable Television Consumer Protection and Competition Act of 1992 <br /> grants the City of Pleasanton, as a franchising authority, the power to <br /> review rates for basic cable television service within its jurisdiction; and <br /> <br />WHEREAS, the City has taken the necessary measures to comply with FCC regulations <br /> governing rate review; and <br /> <br />WHEREAS, TCI submitted to the City Form 1240 and Form 1205 documenting the <br /> Basic and Expanded Tier rates that become effective June 1, 1997; and <br /> <br />WHEREAS, Telecommunica~ons Management Corporation, a professional cable <br /> television regulation consulting fn'm, reviewed on behalf of the City TCrs <br /> Form 1240 and Form 1205 and found the rate for basic service to be <br /> sligh~y below the maximum permitted rate allowable by the FCC; and <br /> <br />WHEREAS, the City is not authorized to regulate the expanded tier rates; and <br /> <br /> WHEREAS, the City has provided reasonable opportunity for' the consideration of the <br /> views of interested parties and has provided TCI with a copy of the <br /> Consultant's report and the staff report to Council on this matter; <br /> <br /> NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON <br /> RESOLVES AS FOLLOWS: <br /> <br /> Section 1: The rates and charges for the Basic Service Tier are hereby accepted. <br /> <br /> Section 2: The City Manager is authorized to issue a complaint to the FCC requesting <br /> that it review and audit the proposed expanded tier rates for consistency <br /> with FCC roles and regulations. <br /> <br /> <br />
