<br />Resolution No. 06- <br />Page 3 of 3 <br /> <br />4, the program funds are expected to be obligated by September 30 of the year the <br />project is programmed for in the TIP. <br /> <br />Section 3: the City of Pleasanton is an eligible sponsor of projects III the Surface <br />Transportation Program; and be it further <br /> <br />Section 4: the City of Pleasanton is authorized to submit an application for Surface <br />Transportation funds for 2007 Annual Resurfacing of Various City Streets; and be <br />it further <br /> <br />Section 5: that there is no legal impediment to the City of Pleasant on making applications for <br />Local Streets and Roadway Shortfall Program funds; and be it further <br /> <br />Section 6: that there is no pending or threatened litigation which might in any way adversely <br />affect the proposed project, or the ability of the City of Pleasanton to deliver such <br />project; and <br /> <br />Section 7: that a copy of this resolution shall be transmitted to the MTC in conjunction with <br />the filing of the applications. <br /> <br />Section 8: that the MTC is requested to support the application for the project described in <br />the resolution and to program the project, if approved, in MTC's TIP. <br /> <br />Section 9: This resolution shall become effective immediately upon its passage and adoption, <br /> <br />I HEREBY CERTIFY THAT THE FOREGOING WAS DULY AND <br />REGULARLY ADOPTED BY THE CITY COUNCIL OF THE CITY OF PLEASANTON, AT <br />A MEETING HELD ON MARCH 7, 2006 BY THE FOLLOWING VOTE: <br /> <br />AYES: <br />NOES: <br />ABSENT: <br />ABSTAIN: <br /> <br />Councilmembers - <br />None <br />None <br />None <br /> <br />ATTEST: <br /> <br />Dawn Abrahamson, City Clerk <br /> <br />APPROVED AS TO FORM: <br /> <br />Michael H.
