Resolution No. PC-2005-22 <br />Page Two <br />2. The proposed location of the conditional use and the conditions under <br />which it would be operated or maintained will not be detrimental to the <br />public health, safety, or welfare, or materially itij urious to the properties or <br />improvements in the vicinity_ <br />Vehicular access is provided to the site directly £rorn Utah Street and indirectly <br />from Wyoming Strc et and Bernal Avenue via the interblock driveways connecting <br />these streets, the service station, and McDonalds to the site_ A raised sidewalit <br />would be provided to the public sidewalk on Utah Street Nineteen parking <br />spaces, including one van-accessible handicapped parking space, arc provided for <br />the proposal, which conforms to the City's parking staiidards_ The gi £t shop is <br />considered an ancillary use to the car way -patronized by customers waiting for <br />their vehicles -and, therefore, would not create its own parking demand; its <br />parking could be used for the carwash employees. Therefore, this second finding <br />can be madc_ <br />3. The proposed conditional use will comply with each o£ the applicable <br />provisions of the Zoning Ordinance. <br />"fhe recommended conditions of approval placed on the project supports the <br />criteria to obtain a conditional use permit and is consistent with the intent of the <br />Pleasanton Municipal Code_ Therefore, this third finding can be made. <br />WHEREAS, the Planning Commission detern~ined that the proposed conditional use would. be <br />compatible with the existing uses in the area. <br />NOW, THEREFORE, THE PLANNING COMMISSION OF TI-IE CITY OF PLEASAN TON <br />RESOLVES TH F__ FOLLOWING= <br />Section 1 . Approves Case PDR-448/PCUP-139, the application of Fairl acid Investment, lnc. <br />for design review approval and conditional use permit fora 7,264-square-foot, <br />bill-service carwash, including a. giR shop and detailing services, on a 7 _77-acre <br />site located at 3595 and 3597 Utah Street, subject to the conditions shown in <br />Exhibit "B," attached hereto and made part of this case by reference. <br />Section 2_ This resolution shall become effective 15 days after its passage and adoption <br />unless appealed prior to that time. <br />
