PLANNING COMMISSION CITY OF PLEASAN TUN <br />ALAMEUA CUUNTY, CALIPURNLA <br />RESOLUTION NO. YC-2005-18 <br />RESOLUTION APPROVING THE APPLICATION OF NEW PLAN EXC7EL REALTY FOK <br />DESIGN REVIEW APPROVAL, AS F1LED UNDER CASE PUD-89-06-2D <br />WHEREAS, New Plan Excel Realty teas applied for design review approval to demolish the <br />existi rig building and construct an approximately 28,650-square-toot single-story <br />retail building at 4200 Rosewood Drive in the Rose Pavilion complex; and <br />WHEREAS, zoning for the property is PUD-C7 ~Ylanned LJnit Development -Commercial) <br />District, and <br />WHEREAS, at its duly noticed public hearing of April 27. 2005, the Planning Commission <br />considered all public testimony, relevant exhibits, and reconin-iendations of the <br />City staff concerning this application; and <br />WHEREAS, an environmental review for the proposed project was undertaken with the Initial <br />Study and Negative Declaration for PLJD-89-06, adopted by the City Council on <br />June 6, 1989, in conformance with the standards of the California Environmental <br />Quality Act ~C EQA~; and th crc arc no substanti a] changes to the project or the <br />circumstances under which the project is being undertaken that involve new <br />significant enviror~rnental effects or that substantially increase the severity of <br />previously identified; furthermore, there is no new information of substantial <br />ixmportance which was unknown at the time the Negative Declaration was adopted <br />regarding the project or its effects, mitigation measures, or alternatives, and any <br />previously identified effects or impacts are mitigated to a level of insignit3cance, <br />with the mitigation measures incorporated into the project's design or imposed <br />pursuant to the conditions of approval; and <br />WHEREAS, the Planning Commission determined that the proposed development conforms to <br />the zoning land use designation for the suhject site. <br />NOW, THEREFORE, THE PLANNING COMMISSION OF THE C=ITY OF PLEASAN TON <br />RF_SOLVF_S THE FOLLOWING= <br />Section 1 _ Approved Case PUD-89-06-2D, the application of New Plan Excel Realty for <br />design review approval to demolish the existing building and construct an <br />approximately 28,650-square-foot single-story retail building at 4200 Rosewood <br />Drive in the Rose Yavilion complex, suhject to the conditions shown in <br />Exhibit "B," attached hereto and made part of this case by reference. <br />
