Adopt the attached resolution that amends Master Fee Resolution 92- <br />100 to add the Vineyard Avenue Agricultural Mitigation Fee in the <br />amount of $25,000 per acre of cultivable or potentially cultivable <br />soils lost to development plus a flat fee component of $645 for the <br />City's costs in administering the fee, which administrative cost <br />component of the fee shall be adjusted in accordance with annual <br />changes to the CPI (consumer price index). <br /> <br />2. Authorize the City Manager to Execute the Agreement for Collection <br />of the Agricultural Mitigation Fee with the Tri-Valley Conservancy <br /> <br />The City adopted the Vineyard Avenue Corridor Specific Plan ("Specific <br />Plan") on June 1, 1999. Pursuant to the Specific Plan, certain property <br />owners are required to pay an agricultural mitigation fee to the City for <br />distribution to Tri-Valley Conservancy (previously South Livermore Valley <br />Agricultural Land Trust) prior to their properties' development. This fee <br />has been imposed through the conditions of approval for applicable <br />development projects, but staff recommends that the fee also be included in <br />the Master Fee Schedule. The amount of the fee is calculated at $25,000 <br />multiplied by the net acreage of potentially cultivable soils less than 25 <br />percent in slope lost to development. A small component to the cover the <br />City's costs in administering the fee would be added to this amount. In <br />addition, staff recommends that the City enter into an agreement with the <br />Tri- Valley Conservancy ("Conservancy") setting forth the responsibilities <br />of both entities in establishing, collecting and using this fee. <br /> <br />Honorable Mayor and Members of the City Council: <br />SR: 06: 032 <br />Page 1 of3 <br />
