ATTACHMENT 3 CITY COUNCIL OF THE CITY OF PLEASANTON ALAMEDA COUNTY, ALAMEDA ORDINANCE NO. AN ORDINANCE APPROVING THE APPLICATION OF SILVERSTONE COMMUNITIES FOR PUD REZONING AND DEVELOPMENT PLAN APPROVAL, AS FILED UNDER CASE PUD-49 WHEREAS, SilverStone Communities has applied for PUD rezoning of an existing 2.76-acre vacant lot from RM-4,000 (Multiple-Family Residential) District to PUD-HDR (Planned Unit Development - High Density Residential) District and for development plan approval for a 45-unit residential condominium development at 3909 Vineyard Avenue; and WHEREAS, based on the Initial Environmental Study, a Negative Declaration was adopted by the City Council on February 21, 2006; and WHEREAS, at its meeting of February 21, 2006, the City Council received the Planning Commission's positive recommendations for approval of the PUD rezoning and development plan; and WHEREAS, a duly noticed public hearing was held on February 21,2006; and WHEREAS, after a review of the materials presented, the City Council determined that the proposed rezoning is appropriate for the site; and WHEREAS, the City Council finds that the PUD development plan is consistent with the General Plan and the purposes of the PUD ordinance. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES HEREBY ORDAIN AS FOLLOWS: Section I. Approves the rezoning of an existing 2.76-acre vacant lot from RM-4,000 (Multiple-Family Residential) District to PUD-HDR (Planned Unit Development- High Density Residential) District. Section 2. The Zoning Map of the City of Pleasant on, dated April 18, 1960, on file with the City Clerk, designating and dividing the City into zoning districts, is hereby amended by Zoning Unit Map No. 464, attached hereto as Exhibit A, dated February 21,2006, and incorporated herein by this reference.
