<br />ATTACHMENT 3 <br /> <br /> <br />CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br />ALAMEDA COUNTY, ALAMEDA <br /> <br />ORDINANCE NO. <br /> <br />AN ORDINANCE APPROVING THE APPLICATION OF SILVERSTONE <br />COMMUNITIES FOR PUD REZONING AND DEVELOPMENT PLAN <br />APPROVAL, AS FILED UNDER CASE PUD-49 <br /> <br />WHEREAS, SilverStone Communities has applied for PUD rezoning of an existing 2.76-acre <br />vacant lot from RM-4,000 (Multiple-Family Residential) District to PUD-HDR <br />(Planned Unit Development - High Density Residential) District and for <br />development plan approval for a 45-unit residential condominium development at <br />3909 Vineyard Avenue; and <br /> <br />WHEREAS, based on the Initial Environmental Study, a Negative Declaration was adopted by <br />the City Council on February 21, 2006; and <br /> <br />WHEREAS, at its meeting of February 21, 2006, the City Council received the Planning <br />Commission's positive recommendations for approval of the PUD rezoning and <br />development plan; and <br /> <br />WHEREAS, a duly noticed public hearing was held on February 21,2006; and <br /> <br />WHEREAS, after a review of the materials presented, the City Council determined that the <br />proposed rezoning is appropriate for the site; and <br /> <br />WHEREAS, the City Council finds that the PUD development plan is consistent with the <br />General Plan and the purposes of the PUD ordinance. <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES <br />HEREBY ORDAIN AS FOLLOWS: <br /> <br />Section I. Approves the rezoning of an existing 2.76-acre vacant lot from RM-4,000 <br />(Multiple-Family Residential) District to PUD-HDR (Planned Unit Development- <br />High Density Residential) District. <br /> <br />Section 2. The Zoning Map of the City of Pleasant on, dated April 18, 1960, on file with the <br />City Clerk, designating and dividing the City into zoning districts, is hereby <br />amended by Zoning Unit Map No. 464, attached hereto as Exhibit A, dated <br />February 21,2006, and incorporated herein by this reference. <br />
