Honorable Mayor and Members of the City Council:

BACKGROUND

In August of 2002, the City Council approved PUD-18 for the development of363 housing units
on the Busch property by Ponderosa Homes. This PUD included the development of a l72-unit
senior apartment project. As part of Council's review of this PUD, it determined that
inclusionary zoning requirements for the entire 363-unit development could be met with 87
affordable units included in the senior apartment project. However, subsequent to this approval,
the developer requested, and the Council approved, a change to the unit mix of the apartment
project resulting in an additional 51 affordable units. As a result of this change, the current unit
mix includes 138 affordable units as follows:

Current Affordabilitv for the Gardens at Ironwood Senior Apartments
Unit Type No. Affordability Levels Current Monthly Rents
Units
One Bedroom 23 50% of AMI (For one $724
person household)
One Bedroom 46 50% of AMI $735
(Based on CDLAC Rents)
One Bedroom 55 60% of AMI (For one $870
person household)
One Bedroom 5 60% of AMI $890
(Based on CDLAC Rents)
One Bedroom 21 Market $995
Two Bedroom 9 60% of AMI $993
Two Bedroom 13 Market $1,150
Total 138
Affordable Units
Market Unit 34

As part of the developer's request to modify the unit mix, it also requested it be granted 51
IUC's as outlined in the IZO. The request was consistent with the IZO since the 138 units
provided were/are in excess of the 87 required affordable units. At its meeting of May 6,
2003, the Council directed this matter to the Planning and Housing Commissions for
review prior to taking action on the request.

The Commissions completed their review in June 2003 and the City Council reviewed this
matter again at its meeting of November 3, 2003. As an outcome of its review, the
Council continued a decision on this matter until it completed an overall review of
the Inclusionary Zoning Ordinance which was scheduled to take place as part of the General

SR:06:052
Page 2
