expressed concern about the blind curve and drivers who drove too fast and was very concerned
about the safety of her children and other neigj1borhood children.

In response to an inquiry by Chairperson Maas whether she had contacted the City with respect
to the speeding problem, Ms. Doty noted that she had not, but the development had a security
guard. She noted that the parking report did not state what time of day the conditions were
observed.

Deepak Malhotra, 5261 Genovesio Drive, spoke in opposition to this item. He expressed
concern about the safety of his children near the streets and that the parents would make U-turns
and use other people's driveways to turn around.

Maria Latsis, 5045 Carducci Drive, spoke in opposition to this item and noted that the blind
corner made parking very difficult. She noted that there was a mix of ages of the children and
that when she had been on the HOA board, they had investigated several traffic calming
measures which were not implemented.

Commissioner Fox inquired whether the Traffic Department could place a lighted speed limit
sign in the neighborhood that would flash when the speed limit was exceeded.

Ms. Nerland noted that a private street such as this did not fall within the jurisdiction of the
Public Works Department.

Jagath Kadurugamuwa, 5210 Genovesio Drive, spoke in opposition to this item and agreed with
the statements made by the other speakers. He noted that he expected a residential neighborhood
when he moved in and did not want the neighborhood to turn into a business area. He expressed
concern about the liability issues as they relate to the HOA and the residents. He inquired what
the age group of the children would be.

Mr. Thuse noted that they had three vehicles, one of which he used to drive to work at 7:30 a.m.;
he generally came home around 9:00 p.m. He noted that the second car was used by his wife and
his college-aged son, who also worked in Dublin. He noted that only one car remained at the
home during the day and that one parking space was set aside for employee use.

THE PUBLIC HEARING WAS CLOSED.

In response to an inquiry by Commissioner Roberts about the procedure if someone in Ruby
Hills (a gated community) were to open a large daycare, Ms. Decker replied that the same
analysis for that development would be performed. Access to the site through the gate would be
presented to the staff and analyzed in the application process.

In response to an inquiry by Commissioner Roberts regarding use of the common playground
and pool, Ms. Decker understood that HOAs are not allowed to restrict the use of the facilities
within the confines of the development.

Commissioner Fox noted that the most recent large family daycare application included
conditions that required the car engine be turned off and that car horns may not be used.

EXCERPTS: PLANNING COMMISSION MEETING MINUTES, July 13, 2005

Page 4 of6
