Commissioner Fox stated she would not support the motion and believed this home would be
suitable for a large family day care. She believed the precedent was set by the City having
approved large family day cares in multi-family residences with smaller than 3,500 square feet
lots and cited Stone Pointe Way as an example. She noted that Stone Pointe Way was a curved
area with smaller sized streets as well. She expressed a bit of concern about enforceability of
traffic violations but believed that since Hacienda Security has a security database, and James
Paxson had indicated that each security issue is reported to the City's Police Department, it
would be easy to manage the conditional use permit.

Commissioner Pearce noted that Ms. Nerland's memo stated that there was a way to enforce the
traffic code if the people who live there so desire. The residents may petition the City Council,
and the Council may direct the street to be treated like a public street. She was struck by the fact
that if the residents were so concerned that the 2,000 trips per day generated a lot of speeders, the
residents may take it upon themselves to bring this issue to the City Council. She believed that if
the community did not take it upon itselfto address these traffic issues, it was tantamount to a de
facto community restriction on large family day cares, to which State public policy was opposed.

ROLL CALL VOTE:

AYES:
NOES:
ABSTAIN:
RECUSED:
ABSENT:

Commissioners Arkin, Blank, Maas, and Roberts.
Commissioner Fox.
None.
None.
None.

Resolution No. PC-2005-38 was entered and adopted as motioned.

EXCERPTS: PLANNING COMMISSION MEETING MINUTES, August ]0,2005
