<br />Status: <br />E-Mail: <br /> <br />Opposed <br /> <br />om-Original Messa <br />From: Peg Zellner <br />Sent: Wednesday, Apri120, 2005 6:15 PM <br />To: Rosalind Rondash <br />Subject: day care center in residential neighborhood. <br /> <br /> <br />Dr Ms Rondash, <br /> <br />It is my understanding that the city is considering changing the zoning of my neighborhood to <br />allow a large family daycare home. <br /> <br />I am writing to state my objections to such a change. When each of the homeowners purchased <br />property in this subdivision we were given a copy of the bylaws and signed an agreement to <br />abide by the regulations. Clearly you can see from the following sections that having ANY kind <br />of day care in the neighbor is against the bylaws that the applicant is now requesting. I would be <br />happy to supply you with a copy of the bylaws if you so desire. <br /> <br />The Valencia Homeowner by laws section 4.16 clearly state that "each residence shall be use <br />solely for residential purposes....no business of any kind shall be established, maintained, <br />operated, permitted or constructed in any portion of the Project. No residence shall be <br />permanently occupied by any more than 2 personal per bedroom. No owner may permit or cause <br />anything to be done or kept upon or in a lot which might obstruct or interfere with the rights of <br />other owners of which would be noxious, harmful or unreasonably offensive to other owners. <br /> <br />Section 4.17 use of common area: all use of common area is subject to the rules. ... "No owner <br />shall permit anything which might result in the cancellation of insurance or any part of the <br />common area, which would interfere with rights of other owners, or which would be a <br />nuisance, nosious, harmful or unreasonably offensive to other owners", <br /> <br />Any additional increase in the use of the common areas, neighborhood or recreational sites <br />would be increasing an already overburdened community sites, private streets and park areas. <br />These facilities were designed for homeowners with standard sized families not day care <br />facilities. Our private streets are already crowded with parked cars, traffic that can be hazardous <br />to our neighborhood children without adding additional business traffic during hours that our <br />children are walking to and from school or playing outdoors after school. <br /> <br />IF the people making this application for change in zoning should have purchased a home <br />without homeowner regulation or not signed the agreement to abide by the regulations. <br /> <br />I would like to respectfully request that this request be denied by the zoning <br />administration. <br /> <br />Thank you. <br /> <br />M Zellner 3843 Appian Street Pleasanton, CA 94588 <br /> <br /> <br />18 (E-MAIL) <br />Date of e-mail: <br /> <br />April 26, 2005 <br />
