<br />item was continued to the following meeting to allow staff to provide the Commission with <br />additional information on streets and traffic enforcement on private streets. <br /> <br />Staff has provided the previous staff reports (with attachments), the minutes of both Planning <br />Commission hearings, and the recent petition that was received as attachments to this report. <br /> <br />SITE DESCRIPTION <br /> <br />The project site is located in a detached, small-lot, single-family development off Gibraltar <br />Drive. The development contains private streets and commonly owned and maintained facilities <br />(open space, play equipment, and pool). The subject site is near the entrance of the development <br />from San Marco Way, at the transition of Appian Street into Genovesio Drive. The applicant has <br />an approximately 3,550-square-foot lot, with an approximately 1,927-square-foot detached two- <br />story, single-family home. The applicant's lot contains four (4) on-site parking spaces and one <br />(I) curbside space directly in front of the residence. <br /> <br />PROJECT DESCRIPTION <br /> <br />Mrs. Thuse is requesting consideration for a conditional use permit to expand her existing small <br />family daycare to a large family daycare. The original expansion request was for up to 14 <br />children, but has since been revised to be for up to II children. The existing facility occupies <br />approximately 787 square feet of the first floor and would operate from 7:00 a.m. to 6:00 p.m. <br />The applicant provided a schedule of daily activities, consisting largely of free time activities, <br />outdoor play, and meal times with the original submittal, which is further discussed in the <br />Planning Commission staff report dated June 22, 2005. <br /> <br />PLANNING COMMISSION HEARING <br /> <br />The Planning Commission reviewed this project at a hearing on August 10, 2005 with an <br />information report from the Assistant City Attorney regarding the additional street information <br />and the parameters for enforcement of traffic laws on private streets. Please see the attached <br />Planning Commission minutes for a full description of the Commission's deliberations. The <br />Planning Commission reviewed the information that was provided by staff, the petition that was <br />submitted by the neighboring homeowners, and listened to public comments. The Planning <br />Commission was unable to make the findings to approve the use permit within this development <br />given the density of the area, the PUD-HDR zoning, traffic, the narrowness of the long looped <br />private street, enforceability of traffic laws, and safety concerns due to a blind corner. Therefore, <br />it denied the conditional use permit request by a 4-1 vote. <br /> <br />SR:06:033 <br />Page 3 <br />
