Box 520 <br />Pleasanton, CA 94566 <br /> <br />PREANNEXATION AND PROVISION OF WATER AND SEWERAGE <br />FACILITIES AND SERVICE AGREEMENT <br /> <br />THIS AGREEMENT is made this 7th day of February, 2006 between the City of <br /> <br />Pleasanton, a municipal corporation (City) and Emie and Beverly Trutner (Owners). <br /> <br />RECITALS <br /> <br />A. Owners are the owners of certain, currently vacant, real property more <br />particularly described in Exhibit A (the Exhibit A property) and incorporated herein by <br />reference. <br /> <br />B. Owners are also the owners of certain real property located at 3631 Vine Street, <br />Pleasanton, CA (APN 946-1704-009-01 and APN 946-1704-009-02), more particularly <br />described in Exhibit A (the Exhibit A property) and incorporated herein by reference. <br /> <br />C. Owners wish to connect the Exhibit A property to the City water and sewer <br />system in order to eliminate reliance on well water and to eliminate the need to construct a septic <br />tan1e <br /> <br />D. Generally, City policy requires property to be annexed prior to extending such <br />City services as water and sewer service. <br /> <br />E. Owners are willing to annex the Exhibit A property either as part of a larger <br />annexation or as part of a smaller annexation involving the properties and other property <br />contiguous to the City. <br /> <br />F. The public health, safety, and welfare ofthe City's residents are well served by <br />eliminating the need for water wells and septic tanks and by connecting to the City's water and <br />sewer system. <br /> <br />G. City is willing to extend its sewer and water services only ifthere is assurances <br />that the properties won't be further subdivided without approval of the City. <br /> <br />NOW, THEREFORE, City and Owner hereby agree as follows: <br /> <br />SR 06 030 Attachment Agreement Revised.doc <br /> <br />1 <br />
