~ Chapter 5.36 TRI VALLEY TOURISM BUSINESS IMPROVEMENT DISTRICT Findings (not to be codified): A. Historically, the cities of Pleasanton, Livermore, Dublin and San Ramon have funded the Tri-Valley Convention & Visitors BUreau in order to promote tourism in the Tri- Valley area. Because of competing demands on the funds of the cities, there is a need to create a stable source of funding tied to tourism. With a stable source of funding, the Tri- Valley Convention & Visitors Bureau will be able to market and promote better the area, thereby increasing business opportunities for Tri-Valley lodging businesses. B. The services to be provided to the lodging businesses are designed to provide target services to such businesses and are not tailored to serve the general public. These services include a tourism promotion program specifically targeted to increase tourism within the Cities of Pleasanton, Livermore, San Ramon and Dublin. C. On October 4, 2005, the Pleasanton City Council adopted Resolution 05-075, a Resolution of Intent to Establish a Tri- Valley Tourism Business Improvement District. Thereafter, the cities of Livermore, San Ramon and Dublin consented to the City of Pleasanton forming a Tourist Business Improvement District that would include the corporate limits of those three cities. On December 6, 2005, the City Council conducted a public hearing to consider the formation of the Tri-Valley Tourism Business Improvement District and to hear any protests as to its formation. There [were none] was no majority protest). 5.36.010 Established: There is established in the Cities of pleasanton, Livermore, San Ramon and Dublin the Tri-Valley TourismBusiness Improvement District [''the District"], under the provisions of the Property and Business Improvement District Law of 1994, as set forth in the Streets and Highways Code of the State, sections 36600 et seq. 5.36.020 Boundaries: The boundaries of the District shall be the corporate limits of the City of Pleasanton, Livermore, San Ramon and Dublin as such corporate limits are amended from time to time. 5.36.030 Amendments to State Law: The businesses and operation of the District shall be subject to any amendments to the Property and Business Improvement District Law of 1994, as amended. 5.36.040 Purpose: The purposes for which the assessments collected under this Chapter shall be used are the statutory purposes set forth in sections 36600 et seq. of the Streets and Highways Code of the State, or one or more of the purposes: EXHIBIT J-
