<br />~ <br /> <br />Chapter 5.36 <br /> <br />TRI VALLEY TOURISM <br />BUSINESS IMPROVEMENT <br />DISTRICT <br /> <br />Findings (not to be codified): <br />A. Historically, the cities of <br />Pleasanton, Livermore, Dublin <br />and San Ramon have funded the <br />Tri-Valley Convention & <br />Visitors BUreau in order to <br />promote tourism in the Tri- <br />Valley area. Because of <br />competing demands on the funds <br />of the cities, there is a need to <br />create a stable source of funding <br />tied to tourism. With a stable <br />source of funding, the Tri- Valley <br />Convention & Visitors Bureau <br />will be able to market and <br />promote better the area, thereby <br />increasing business opportunities <br />for Tri-Valley lodging <br />businesses. <br />B. The services to be provided to <br />the lodging businesses are <br />designed to provide target <br />services to such businesses and <br />are not tailored to serve the <br />general public. These services <br />include a tourism promotion <br />program specifically targeted to <br />increase tourism within the <br />Cities of Pleasanton, Livermore, <br />San Ramon and Dublin. <br />C. On October 4, 2005, the <br />Pleasanton City Council adopted <br />Resolution 05-075, a Resolution <br />of Intent to Establish a Tri- <br />Valley Tourism Business <br />Improvement District. <br />Thereafter, the cities of <br />Livermore, San Ramon and <br />Dublin consented to the City of <br />Pleasanton forming a Tourist <br /> <br />Business Improvement District <br />that would include the corporate <br />limits of those three cities. On <br />December 6, 2005, the City <br />Council conducted a public <br />hearing to consider the <br />formation of the Tri-Valley <br />Tourism Business Improvement <br />District and to hear any protests <br />as to its formation. There [were <br />none] was no majority protest). <br /> <br />5.36.010 Established: <br />There is established in the Cities of <br />pleasanton, Livermore, San Ramon and <br />Dublin the Tri-Valley TourismBusiness <br />Improvement District [''the District"], <br />under the provisions of the Property and <br />Business Improvement District Law of <br />1994, as set forth in the Streets and <br />Highways Code of the State, sections <br />36600 et seq. <br /> <br />5.36.020 Boundaries: <br />The boundaries of the District shall <br />be the corporate limits of the City of <br />Pleasanton, Livermore, San Ramon and <br />Dublin as such corporate limits are <br />amended from time to time. <br /> <br />5.36.030 Amendments to State Law: <br />The businesses and operation of the <br />District shall be subject to any <br />amendments to the Property and <br />Business Improvement District Law of <br />1994, as amended. <br /> <br />5.36.040 Purpose: <br />The purposes for which the <br />assessments collected under this Chapter <br />shall be used are the statutory purposes <br />set forth in sections 36600 et seq. of the <br />Streets and Highways Code of the State, <br />or one or more of the purposes: <br /> <br />EXHIBIT J- <br />
