CITY COUNCIL OF THE CITY OF PLEASANTON ALAMEDA COUNTY, CALIFORNIA RESOLUTION NO. 97-11 RESOLUTION DENYING THE APPEAL OF CELE AND RICH GUTIERREZ OF A DECISION OF THE PUBLIC WORKS DIRECTOR THEREBY DENYING THE REQUEST TO REMOVE A HERITAGE TREE AT 3590 CHURCHILL COURT Cele and Rich Gutierrez are the owners of property at 3590 Churchill Court and on that property is a Sycamore tree that is a heritage tree under the City's Heritage Tree Ordinance (Chapter 17.16. Pleasanton Municipal Code); and WHEREAS, on October 24, 1996, Mr. and Mrs. Gutierrez requested removal of the tree because they felt the tree poses a hazard to the roof of their home; and the Director of Public Works determined that the necessary findings under the Ordinance could not be made and therefore denied the request of Mr. and Mrs. Gutierrez to remove the heritage tree; and WHEREAS, Mr. and Mrs. Gutierrez appealed that decision to the City Council; and i/HEREAS, at its meeting of February 18, 1997, the City Council considered the report of the Public Works Director (SR 97:47) and conducted a hearing on the appeal; and the City Council finds and detennines that the tree is not diseased, does not meet any of the other criteria for removal under the Ordinance, and that the tree has not recenfiy been pruned in order to remove broken, dead or multiple limbs from the tree. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES AS FOLLOWS: Section 1: The appeal of Mr. and Mrs. Gutierrez is denied, thereby denying their request to remove the heritage tree from the property at 3590 Churchill Court.
