CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br />RESOLUTION NO. 97-11 <br /> <br />RESOLUTION DENYING THE APPEAL OF CELE <br />AND RICH GUTIERREZ OF A DECISION OF THE <br />PUBLIC WORKS DIRECTOR THEREBY DENYING <br />THE REQUEST TO REMOVE A HERITAGE TREE <br />AT 3590 CHURCHILL COURT <br /> <br />Cele and Rich Gutierrez are the owners of property at 3590 Churchill Court <br />and on that property is a Sycamore tree that is a heritage tree under the <br />City's Heritage Tree Ordinance (Chapter 17.16. Pleasanton Municipal <br />Code); and <br /> <br />WHEREAS, on October 24, 1996, Mr. and Mrs. Gutierrez requested removal of the tree <br /> because they felt the tree poses a hazard to the roof of their home; and <br /> <br />the Director of Public Works determined that the necessary findings under <br />the Ordinance could not be made and therefore denied the request of Mr. <br />and Mrs. Gutierrez to remove the heritage tree; and <br /> <br />WHEREAS, Mr. and Mrs. Gutierrez appealed that decision to the City Council; and <br /> <br />i/HEREAS, <br /> <br />at its meeting of February 18, 1997, the City Council considered the report <br />of the Public Works Director (SR 97:47) and conducted a hearing on the <br />appeal; and <br /> <br />the City Council finds and detennines that the tree is not diseased, does not <br />meet any of the other criteria for removal under the Ordinance, and that the <br />tree has not recenfiy been pruned in order to remove broken, dead or <br />multiple limbs from the tree. <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON <br />RESOLVES AS FOLLOWS: <br /> <br />Section 1: <br /> <br />The appeal of Mr. and Mrs. Gutierrez is denied, thereby denying their <br />request to remove the heritage tree from the property at 3590 Churchill <br />Court. <br /> <br /> <br />
