HEREAS, <br /> <br />"h <br /> <br />NOW, <br />RESOLVES <br /> <br />Section 1: <br /> <br />Section 2: <br /> <br />CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br />RESOLUTION NO. 97-09 <br /> <br />RESOLUTION AUTHORIZING THE CITY MANAGER <br />TO ACCEPT ON BEHALF OF THE CITY TWO <br />CONSERVATION EASEMENTS FOR ~ RUBY <br />HHjL DEVELOPMENT AND AUTHORIZING THE <br />CITY ATTORNEY TO APPROVE AS TO FORM A <br />CONSERVATION EASEMENT TO THE SOUTH <br />LIVERMORE VALLEY AGRICULTURAL LAND <br />TRUST <br /> <br />the conditions of approval for the Ruby Hill development require that <br />certain open space areas - the golf course, the tiger salamander habitat, and <br />the areas to be planted with vineyards - be placed under a conservation <br />easement; and <br /> <br />the City has received two conservation easements from the Ruby Hill <br />Development Partners, L.P. to the City of Pleasanton concerning the golf <br />course and the habitat, and has reviewed an agricultural conservation <br />easement from Wente Bros. to the South Livemore Valley Agricultural <br />Land Trust concerning the areas to be planted with vineyards; and <br /> <br />at its meeting of February 18, 1997, the City Council received a report from <br />the City Attorney (SR 97:56) recommending that the two easements to the <br />City be accepted and that the easement to the South Livermore Valley <br />Agricultural Land Trust be approved as to form; <br /> <br />THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON <br /> AS FOLLOWS: <br /> <br />The two conservation easements from the Ruby Hill Development Partners <br />to the City of Pleasanton are hereby accepted and the appropriate City <br />officers are instructed to take whatever action necessary to implement said <br />acceptance. <br /> <br />The agricultural conservation easement from Wente Bros. to the South <br />Livemore Valley Agricultural Land Trust is approved as to form and the <br />City Attorney is authorized to so indicate on the easement. <br /> <br /> <br />
