<br />Staff has crafted a condition providing the mechanism to attain the acceptance of the offer of <br />dedication by Zone 7. If, for some reason, the offer of dedication is not accepted, the <br />homeowners association for the Rosalyn Lane project will be responsible for both ownership <br />and maintenance. In order to have adequate reserve funds for this purpose, the City requested <br />Engeo, Inc. to prepare an estimate of costs for catastrophic failure and ongoing maintenance, <br />which are shown in Attachment 8. The costs for a catastrophic event consider a complete <br />embankment failure along with complete bank reconstruction. Maintenance costs would be <br />those for brush clearing, miscellaneous pruning, and annual inspection verifying slope stability. <br /> <br />A related issue is the width of Street B, the creek-side street, which may need to be narrowed to <br />meet Zone 7's slope requirement. The City has determined that since Street B will not have <br />significant use, is not a collector, is not connected yet to any other circulation pattern, and will <br />primarily function for some time as a maintenance road, the width could be reduced to no less <br />than 20 feet, if necessary, keeping the lot sizes, floor plans, and site design as submitted. The <br />public trail would likely undergo some design revisions as well to accommodate Zone 7's <br />2Yz:lline of projection. <br /> <br />Staff recommends the plans be amended to reflect the 2Yz: I line of projection resulting in a <br />reduction of the road and trail widths and maintaining the lot sizes, patterns, and house plans <br />per the plan submittal. A condition has been provided to respond to the changes. <br /> <br />PUBLIC COMMENT <br /> <br />Notice of the application was sent to all property owners and tenants living within 1,000 feet of <br />the subject property as well as all property owners and residents of the Nolan Farms <br />development. In addition, the City advertised the notice in the newspaper and posted the <br />document in front of200 Old Bernal Avenue. Please refer to the preceding section of the staff <br />report for a full discussion of public comment. <br /> <br />ENVIRONMENTAL ASSESSMENT <br /> <br />A Draft Negative Declaration was prepared in. conjunction with the proposed Planned Unit <br />Development plan and submitted to the State Clearinghouse. Based on the Initial Study and <br />Negative Declaration, the project would not have a significant effect on the environment. The <br />proposed project plans have been revised to avoid significant effects or mitigated by design to a <br />point where the effects are insignificant, and there is no substantial evidence that the project, as <br />revised, may have a significant effect.
