<br />included as Attachment 5 and indicates the probable relationship and distances between the two <br />structures. <br /> <br />Mr. Nassar indicated he would be able to attend a November hearing date, preferably after <br />November 9, 2005, so that he could address the Planning Commission directly regarding his <br />concerns. The Planning Commission hearing was continued to November 16,2005 at which <br />time Mr. Nassar was unable to attend to provide testimony. In recommending approval of this <br />PUD, the Planning Commission has supported a two-story custom home on Lot 9 subject to its <br />review and approval. <br /> <br />Other concerns identified are related to the loss of trees on the site. Staff has responded by <br />confirming a Tree Survey and Report was conducted. There are 79 trees identified within the <br />report determining the suitability ofretention and condition of the trees. Most of the trees on <br />site are remnant decaying walnut orchard trees that are poor candidates for preservation. The <br />arborist updated the tree report, and over time, the trees on site have decayed further. The only <br />trees identified for preservation are tree number 59, a large sycamore, and the small grove of <br />pines located on the Jones property. Care will be taken that grading, along with other site <br />improvements, not impact the integrity of their trees. Conditions of approval incorporate the <br />recommendations of the arborist during site construction. <br /> <br />Zone 7-Arrovo Del Valle Slope Stability <br /> <br />The northerly portion of property lies within the Arroyo Del Valle channel bottom and <br />embankment. The Arroyos have varying ownerships: those of Zone 7, Alameda County, the <br />City, various homeowners associations, and private ownerships. In an effort to support the <br />mission statement of Zone 7, the City initiated and requested the applicant enter into discussion <br />related to dedication of the lands lying within the Arroyo confines proper. The Zone 7 'Interim <br />Design Standards and Practices,' dated April 21, 1999, (E) Channel Side Slopes states: <br /> <br />" Channel side slopes shall not be steeper than 2 y:,: I unless a report prepared by a <br />licensed geotechnical engineer demonstrates that a steeper side slope can be <br />accommodated without adverse impacts." <br /> <br />The applicant retained Engeo, Inc. to conduct a hydraulic evaluation and bank erosion analysis <br />to effectively determine slope stability and provide recommendation for setbacks for road or <br />building construction. On page 10 of its report, dated March 10,2005, the recommendations <br />are: <br />. 3: I (horizontal:vertical) line of projection from the toe of the creek bank to the top of <br />the bank plus an additional horizontal distance of 15 feet for habitable structures. <br />. 2: I (horizontal:vertical) line of projection from the toe of the creek bank to the top of <br />the bank for non-habitable improvements, including the proposed roadway fronting <br />the Arroyo Del Valle Creek. <br /> <br />SR06:013 <br />Page II of 17 <br />
