.

.

conditioned, the approval 01 the retractable canvas avvning vvould not cause undue ad-
verse impacts to the neighbors or the development as a vvhole.

As noted, starl typically supports the position of homeovvners associations regarding de-
sign issues related to their particular development. Starl understands and respects the
Rosepark HOA's position that the avvning does not meet its aesthetic standards. Hovvever,
starr also considers requests such as Mr. Fischer's in a broader context and tries to ac-
commodate proposals that are reasonable and avoid neighborhood impacts. While recog-
nizing that this is a small-lot, zero lot-line development vvhere additions and accessory
structures have greater potential to impact neighbors than in a conventional development, .
starr believes that the lovv height, the setbacks, and the retractable nature 01 the avvning
mitigate its impact. Stafl, therefore, is supporting a modification to the PUD to allovv the
avvning lor this site only, not lor the entire PUD. Hovvever, if thc Commission finds that
the avvning has negative aesthetic or other impacts, then it should recolnmend the request
be denied.

STAFF RECOMMENDATION

Starl recommends that the Planning Commission recommend to the City Council ap-
proval orCase PUD-85-01-4M subject to the conditions listed in Exhibit B.

Staff Planner: Leslie Mendez.
