<br />Honorable Mayor and Melubers ot-the City Council: <br /> <br />BACKGROUND <br /> <br />The keeping ot- fovvl is a conditionally penuitted use in One-Faluily Residential (R-l) districts, A <br />conditional use permit can be approved by the Planning COlumission provided the use is <br />consistent vvith the provisions of Section 736, Miscellaneous Anilual Regulations, of the <br />Pleasanton Municipal Code (PMC), and iftheOconditional use application lueets the required use <br />penuit findings ofPMC Section 1801240 The Code prohibits the keeping or maintenance of any <br />aniluals in such luanner, nUluber, or kind as to cause daluage or hazard to persons or property in <br />the vicinity or to generate otTensive noise, dust, or odor. <br /> <br />Recently the City has received several requests to process a conditional use permit to keep <br />chickens as pets and for related 4-H Club projects, The City has been processing conditional use <br />permits for the keeping of chickens ~ithin the R-l residential districts and, thus far, the Planning <br />Comluission has approved tvvo use penuitso The conditional use penuit process for these t~o <br />applications varied significantlyo The impact chickens had at both locations ~as determined to <br />be very little; hovvever, staff found the use permit process turned into a forulu to discuss other <br />neighborhood issues, unrelated in lUOSt cases to the chickenso During the processing of the use <br />penuits, the Planning COIUluission requested additional information related to the required <br />process for a potential Code aluendment allo~ing chickens to be kept in One-Family Residential <br />districtso Additionally, the City Council requested that stan-process a Code aluendluent that <br />~ould allo~ chickens to be kept in these zoning districts, On Deceluber 14,2005, by a <br />5-to-0 vote, the Planning COIUluission reCOlUluended approval of the proposed Code aluendluents <br />to allovv, as a penuitted use, the keeping of up to six hens in R-l Residential zoning districts if <br />certain criteria are lueto <br /> <br />PROJECT DESCRIPTION <br /> <br />Staff is proposing aluendluents to the Pleasanton Municipal Code in order to cOluply ""vith the <br />direction of both the City Council and the Planning COIUluission. These aluendments ~ould <br />permit the keeping of up to six feluale chickens, no roosters or capons, and allovv them to be kept <br />as pets in a One-Faluily Residential district if certain standards are lueto The approval process <br />vvould be an 'over the counter' process that vvould rely on an applicant producing an adequate <br />level of infonuation confinuing the proposed standards ~ould be lueto In this luanner, a <br />streamlined, luinisterial process ~ould allo~ the keeping of chickens as a permitted use vvithout <br />the need for a public hearing at the Planning Commissiono <br /> <br />SR 06:015 <br />Page 2 of7 <br />
