<br />Honorable Mayor and Members of the City Council: <br /> <br />BACKGROUND <br /> <br />Frank and Marie Silveira are requesting City W'ater and se~er services for their existing residence <br />located at 849 Sycamore Road across from the Bridle Creek subdivsion. This residence is <br />located on a 1.2-acre parcel outside the City limits. <br /> <br />The ~ater quality from their existing W'ell is poor. Water service could be provided by <br />connection to the 8" W'ater main on Sycamore Roado A marginally serviceable septic tank: and <br />leach field currently serves the existing residence. There currently exists an 8" sanitary se~er <br />line located along Sycamore Road, to W'hich the Silveira parcel could connecto The Alameda <br />County Department of Environmental Health restricts repairs or installation of septic systems <br />W'hen a sanitary seW'er is W'ithin 200 feet of the property. <br /> <br />Pre-annexation and Provisions of Sanitarv SeW'er and Water Service Agreement <br /> <br />Historically, ~hen an o~ner of property located outside the City limits requests seW'er and W'ater <br />services, the City has granted such request only after determining that the use on the property to <br />be serviced is consistent W'ith the City's General Plan, and after receiving assurances that the <br />property o~ner ~ill enter into a preannexation agreement. This agreement alloW's the ovvner to <br />connect to the City's seW'er and W'ater systems prior to the property being annexed to the City <br />providing the follo~ing requirements are met: The property oW'ner agrees to (a) pay the seW'er <br />and W'ater connection fees, (b) pay all costs associated ~ith the connection to and use of the ~ater <br />and se~er systems, (c) abandon the existing septic system on the property, (d) pay all City and <br />County processing fees for LAFCo approval, and (e) support any subsequent annexation <br />initiative that may occur. <br /> <br />Conclusion <br /> <br />The City normally requires that properties annex to the City in order to receive City utility <br />services 0 The Silveira parcel is contiguous to the City Limit boundary line; ho~ever, this parcel <br />is only 102 acres and annexing in small ..piece meal" annexations is discouraged by LAFCoo <br /> <br />At this time, staff recommends that the City Council authorize the seW'er and W'ater connections <br />requested by the Silveira's, W'ith an agreement to annex at some future date as part of a larger <br />annexation areao <br /> <br />SR:06:008 <br />Page 2 of3 <br />
