<br /> <br />4D <br /> <br />- 'II. . <br /> <br />pLEASANTON.. <br /> <br />City Council <br />Staff Report <br /> <br />January 3, 2006 <br />Public Works Department <br /> <br />SUBJECT: <br /> <br />ACCEPTANCE OF THE CALLIPPE PRESERVE GOLF COURSE <br />AND OPEN SPACE PROJECT, PROJECT NO. 968036 <br /> <br />STAFF RECOMMENDATION: <br /> <br />Staff recommends that the City Council take the follo~ing action at the <br />meeting of January 3, 2006: <br /> <br />10 Accept the improvements for the subject project. <br /> <br />2. Direct the City Clerk to file a Notice of Completion for the subject <br />project. <br /> <br />3. Authorize release of the remaInIng retention thirty days after filing a <br />Notice of Completion, less liquidated damages, and subject to removal of <br />stop notices on the project. <br /> <br />SUM:MARY <br /> <br />The construction of the Callippe Preserve Golf Course and Open Space <br />Project is complete and ready for acceptance. <br /> <br />The City a~arded a $16,524,214005 contract to Ferma Corporation. There <br />have been sixty-five change orders issued, totaling $2,544,497071, for an <br />adjusted contract cost of$19,068,71 1.76. The final payment request has not <br />yet been approved. Once approved, it is expected that the adjusted contract <br />cost ~ill be reduced by approximately $1 million, due to ~ork ~hich ~as <br />not required to be performed. Once the project is accepted, it is expected that <br />Ferma ~ill submit final claims to the City for resolution. The City "Will <br />attempt to negotiate the claims "When they are submitted; ho~ever, the City <br />may need to enter arbitration ~ith Ferma to resolve the outstanding claims. <br /> <br />The project exceeded the contract ~orking days, and liquidated damages <br />~ill be deducted by the City from the final contract costo The amount of the <br /> <br />SR 06:003 <br />Page 1 of3 <br />
