In response to an inquiry by Commissioner Maas, Mr_ SwiR noted that procedures had <br />not been set forth to ensure that the Chrisniarzs did not use their well if a drought <br />condition existed. Staff had hoped that the two parties would be able to come to an <br />agreement in the event of a drought_ <br />Commissioner Sulliva~z advised that the condition stated that the Brozoskys would notify <br />the Chrismans in writing of a low water condition_ <br />Mr_ SwiR advised that if the two parties were not able to come to an agreement, the <br />Brozoskys would contact the Planning Department. Planning staff would estimate the <br />water t7ow, and ask the Chrismans not to use the well_ <br />In respo~zse to err inquiry by Comn-rissioner Maas, Mr. Swig advised that the Planning <br />Commission may wish to separate the well issue from the tentative reap, and address the <br />well at the final map_ <br />Commissioner Sullivan advised that this project had a long history, and that he had never <br />been happy with the project. He advised that he could not make the Finding 1 or Finding <br />4. He believed that the changes in grading and the retaining walls, as well as the increase <br />in excavation, constituted a major change to the PUD. I-Ie could not support the tentative <br />map, regardless of the well issue_ <br />Chairperson Arkin agreed with Commissioner Sullivan's assessment, and added that he <br />had never supported the proj ect_ Because this issue would be heard by Council, he wished <br />to provide some information that would be helpful to Council. He would like to sec <br />visuals of the retaining walls. <br />Commissioner Sullivan suggested that because Lots 17, l 8, and 1 9 had been razed, that <br />visuals of those areas would be useful as wcll_ <br />Commissioner Sullivan noted that the major problems would occur when somebody runs <br />out of water. If the well starts running dry, the Chrismans have the ability to open up the <br />valve on the City water pipe; the Brozoskys would not have that ability without <br />considerable time and expense_ He believed that it would be lair for the G'hrism ens to <br />curtail their water use until the problem with water flow had passed. <br />C'orrrmissioner Maas agreed with Commissioner Sullivan's assessment, and did not agree <br />with the definition of domestic use. She prioritized domestic use as tap water, animals, <br />and irrigation, in that order. <br />Commissioner Sullivan believed it was very important for the City to set a consistent <br />policy with respect to these instances. <br />Chairperson Arkin agreed with Ms. Roberts' statement that the people doing the <br />subdivision should discontinue use of the well, and believed that it was a reasonable <br />PLANNING COMMISSION MINUTES July 9, 2003 Page 9 <br />
