<br /> <br />CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br />ALAMEDA COUNTY, ALAMEDA <br /> <br />ORDINANCE NO. 1926 <br /> <br />AN ORDINANCE UPHOLDING THE APPEAL, CASE PAP-83, <br />THEREBY APPROVING THE APPLICA nON OF RON AND KIM <br />WINTER FOR PUD REZONING AND DEVELOPMENT PLAN <br />APPROVAL, AS FILED UNDER CASE PUD-37 <br /> <br />WHEREAS, Ron and Kim Winter have applied for Planned Unit Development <br />(PUD) rezoning and development plan approval to rezone the <br />property located at 520 St. John Street from RM-15 <br />(Multiple-Family Residential) to PUD-HDR (Planned Unit <br />Development - High Density Residential) and to allow the <br />construction of four single-family detached residences and two <br />attached multi-family residential units; and <br /> <br />WHEREAS, at its meeting of May 11, 2005, the Planning Commission, after <br />having considered all public testimony, relevant exhibits, and <br />recommendations of City staff concerning this application, denied <br />the application; and <br /> <br />WHEREAS, within the time specified by the Pleasanton Municipal Code, the <br />applicant submitted an appeal to the decision of the Planning <br />Commission; and <br /> <br />WHEREAS, at its meeting of September 20, 2005, the City Council reviewed the <br />report from the Director of Planning and Community Development <br />together with copies of staff reports to the Planning Commission <br />regarding this matter; and <br /> <br />WHEREAS, the City Council held a public meeting on September 20, 2005, at <br />which time the applicant and other members of the public were <br />offered an opportunity to present evidence regarding this appeal; and <br /> <br />WHEREAS, after a review of the materials presented, the City Council <br />determined that the proposed rezoning is appropriate for the site; and <br />
