Ordinance No. 1828 <br />Page Two <br /> <br />11.40.040 Hearing Officer. For the purposes of this Chapter, the Chief of Police <br />shall designate certain police officers to serve as hearing officers. Hearing officers <br />shall be available on a twenty-four (24) hour basis and shall be of a rank greater <br />than the officer or police employee who ordered the tow to be made. <br /> <br />11.40.050 - 11.40.070, no changes. <br /> <br />11.40.080 Appeal. The decision of the hearing officer may be appealed to the <br />City Manager or the City Manager's designate during regular City business hours. <br />The decision of the City Manager or the City Manager's designate shall be final. <br /> <br />11.40.090, no changes. <br /> <br />11.40.100 Administrative Fee for Certain Towed Vehicles. In addition to <br />satisfying the other requirements of sections 22651 or 14602.6 of the Vehicle <br />Code, as applicable, the owner of any vehicle towed pursuant to section 11.40.010 <br />of this Chapter shall pay to the City an administrative fee as established by City <br />Council resolution. The owner shall pay this administrative fee prior to the release <br />of the vehicle." <br /> <br />Section 2: <br /> <br />A summary of this ordinance shall be published once within fifteen (15) days after <br />its adoption in "The Tri-Valley Herald," a newspaper of general cimulation <br />published in the City of Pleasanton, and the complete ordinance shall be posted for <br />fifteen (15) days in the City Clerk's office within fifteen (15) days after its <br />adoption. <br /> <br />Section 3: <br /> <br />This ordinance shall be effective thirty (30) days after the date of its final passage <br />and adoption. <br /> <br />INTRODUCED at a regular meeting of the City Council of City of Pleasanton on April 3, 2001. <br /> <br />ADOPTED at a regular meeting of the City Council of City of Pleasanton on April 17, 2001 by <br />the following vote: <br /> <br /> <br />
