CITY COUNCIL OF THE CITY OF PLEASANTON <br />ALAMEDA COUNTY, CALIFORNIA <br />ORDINANCE NO. 1827 <br /> <br />AN ORDINANCE APPROVING THE APPLICATION OF <br />NEW CITIES DEVELOPMENT GROUP FOR A MAJOR <br />MODIFICATION, AS FILED UNDER CASE PUD-97-12-1M <br /> <br />WHEREAS, <br /> <br />at its meeting of October 26, 1999, Council adopted Ordinance No. <br />1791 approving a Planned Unit Development plan for 48 new <br />single-family residential lots and the retention of one existing <br />single-family home on an approximately 34.7-acre site located at 970 <br />and 986 Sycamore Road in the North Sycamore Specific Plan area, <br />subject to certain conditions; and <br /> <br />WHEREAS, <br /> <br />New Cities Development Group has applied for a major modification to the <br />approved Planned Unit Development (PUD-97-12) to remove Condition No. 99, <br />which requires the annexation of the Happy Valley Specific Plan area in order for <br />the New Cities' project approval to be effective; and <br /> <br />WHEREAS, the Planning Commission has reviewed this application at its meeting of <br /> January 10, 2001 and forwarded its recommendations to Council; and <br /> <br />WHEREAS, projects of this nature are categorically exempt from the requirements of the <br /> California Environmental Quality Act (CEQA), therefore, no environmental <br /> document accompanies this application; <br /> <br />THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES HEREBY ORDAIN AS <br />FOLLOWS: <br /> <br />Section 1: <br /> <br />Approves the modification to the development plan, PUD-97-12, subject to the <br />conditions shown on Exhibit "A", attached hereto and incorporated herein by this <br />reference. <br /> <br />Section 2: <br /> <br />A summary of this ordinance shall be published once within fifteen (15) days after <br />its adoption in "The Valley Times," a newspaper of general circulation published <br />in the City of Pleasanton, and the complete ordinance shall be posted for fifteen <br />(15) days in the City Clerk's office within fifteen (15) days after its adoption. <br /> <br /> <br />
